This program includes two types of use cases: transactional messages (appointment reminders, scheduling confirmations, and support replies) and promotional messages (marketing offers and proposals). Message frequency varies based on your interaction.

12. Dispute Resolution: Class Action and Jury Trial Waiver

ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE IN ANY FORUM WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR SOLVIFY360 WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. YOU AND SOLVIFY360 IRREVOCABLY WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.

13. Governing law and venue

These Terms and any disputes related to them are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any legal actions or proceedings shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

15. Changes to these Terms

We may update these Terms at any time. The “Last updated” date above reflects the latest revision. Your continued use of the site after changes are posted constitutes your acceptance of the updated Terms.
